Ferguson Education & Migration (ABN 45 141 059 458) is committed to protecting your privacy. This policy explains how we collect, hold, use and disclose personal information when you use this website, contact us, attend a seminar, or become a client.
We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). As a MARA-registered migration practice (Registration No. 1681792), we are also bound by the OMARA Code of Conduct, which requires us to protect your privacy and act in your best interests.
1. Who we are
Ferguson Education & Migration is an education and migration consultancy headquartered at Ferguson Corporate Centre, Level 2/14 Edgewater Ct, Robina QLD 4226. We operate study centres and offices in Australia, Papua New Guinea, Fiji and the Philippines, and we assist families across the Pacific.

2. What this policy covers
This policy applies to:
- visitors to this website (ferguson4me.com and related pages)
- people who submit an enquiry, seminar, guide, newsletter or YESS Fund form
- clients and prospective clients of our education and migration services
- parents and guardians who provide information about a child in their care
It does not cover third-party websites we link to (for example, education providers, Home Affairs, or social media). Their own privacy policies apply.
3. What we collect
Website and enquiry forms
Depending on the form you use, we may collect:
- name, email address, phone number, country and city
- whether you are an existing client, and the type of enquiry
- study destination, intended timing, and a message you choose to send
- seminar preferences (for example, parent/student, school level, virtual or in-person)
- which free guide you requested
- for YESS Fund enquiries: parent or guardian name, child’s current age, preferred destination, and how you heard about us
- the page you submitted from
Education and migration services
If you become a client, we collect the information needed to advise you and lodge applications. That can include identity documents, education history, employment history, financial information, family composition, and — where required for a visa — health and character information. Health and character information is sensitive information under the Privacy Act. We only collect it where it is reasonably necessary for our services and permitted by law (for example, with your consent or as required to make a visa application).
Website usage
We use Vercel Analytics to understand how this website is used (for example, which pages are visited). This is aggregated or de-identified as far as practicable and is not used to identify you for marketing.
We may display limited, first-name and country style activity notices on the website (for example, that someone from a particular country recently made an enquiry). These notices do not include contact details.
4. How we collect information
We collect personal information:
- directly from you — website forms, email, phone, WhatsApp, seminars and in-person meetings
- from a parent, guardian or family member acting on a student’s behalf
- from third parties you authorise, such as education providers, English-test centres, or government agencies, when we are acting for you
If you do not provide information we reasonably need, we may not be able to respond to your enquiry or provide our services.
5. Why we collect and use it
We use personal information to:
- respond to enquiries and provide education and migration advice
- register you for seminars and send requested guides
- administer the YESS Fund and other services you ask about
- prepare and lodge applications with education providers and government agencies
- send service messages (for example, confirming we received your form)
- send newsletters and updates about courses, visas and seminars, where you have subscribed or it is otherwise permitted
- improve this website and our services
- meet our legal, professional and record-keeping obligations, including MARA requirements
6. Who we share information with
We disclose personal information only as needed for those purposes, including to:
- our staff and contractors in Australia and our Pacific offices, on a need-to-know basis
- education providers, homestay or accommodation partners, and insurers, when you ask us to arrange those services
- the Department of Home Affairs, Immigration New Zealand, and other government bodies, when lodging or managing an application
- IT, hosting, email and database providers who process information on our behalf to run this website and our communications
- professional advisers, or as required by law, a court, or a regulator such as OMARA or the OAIC
We do not sell your personal information.
7. Overseas disclosure
We operate across Australia, Papua New Guinea, Fiji and the Philippines. Your information may be accessed by our team in those countries. Some of our website, email and database providers may store or process information on servers outside Australia, including in the United States.
Where we disclose personal information overseas, we take reasonable steps to ensure it is handled in a way that is consistent with the Australian Privacy Principles, unless an exception under the Privacy Act applies (for example, you consent, or the disclosure is required to complete an application you have asked us to make).
8. Storage and security
Website form submissions are stored in our database and emailed to our team at help@ferguson4me.com. You will usually receive an automated acknowledgement at the email address you provide.
We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure. Access to client files and internal systems is limited to authorised staff. No method of transmission or storage is completely secure; please do not send original identity documents through an unsolicited website form.
We keep information for as long as we need it for the purposes above, including legal and professional record-keeping periods that apply to migration agents, and then take reasonable steps to destroy or de-identify it.
9. Cookies and similar technologies
This website uses cookies and similar technologies that are needed to operate the site (for example, security and preview sessions) and to measure usage via Vercel Analytics. Staff sign-in to our internal admin area uses a separate authentication service and is not required for public visitors.
10. Direct marketing
If you subscribe to our newsletter, we use your email to send updates. You can unsubscribe using the link in those emails, or by contacting help@ferguson4me.com. We will honour opt-out requests promptly.
11. Children and family information
We often deal with parents and guardians planning a child’s education. We collect a child’s details (such as age or school level) from the adult who contacts us, not from the child, except where a student is dealing with us directly and it is reasonable in the circumstances. Please only provide a child’s information if you have authority to do so.
12. Access, correction and complaints
You may request access to the personal information we hold about you, or ask us to correct it, by emailing help@ferguson4me.com. We will respond within a reasonable time. In some cases we may refuse access where the Privacy Act allows (for example, where giving access would unreasonably affect someone else’s privacy). If we refuse, we will explain why, unless it is unreasonable to do so.
If you are not satisfied with how we have handled your personal information, please contact us first so we can try to resolve it. You may also complain to the Office of the Australian Information Commissioner (oaic.gov.au). Complaints about a registered migration agent can be made to OMARA (mara.gov.au). Making a complaint does not affect a visa application.
13. Changes to this policy
We may update this policy from time to time. The current version will always be published on this page with the last-updated date. Material changes will apply from the date of publication.
